Terms and Conditions of Use

1. Acceptance of Terms
These Terms and Conditions of Use (hereinafter "Terms") govern the access and use of the mobile application Tennis-IA and the website tennis-ia.com (hereinafter collectively "the Service"), provided by TennisIA (hereinafter "TennisIA", "we", or "us").
By registering, accessing, or using the Service, you declare that you have read, understood, and fully accepted these Terms and our Privacy Policy. If you do not accept these Terms, you may not use the Service.
TennisIA reserves the right to modify these Terms at any time. Changes will be communicated via the app or published on this page. Continued use of the Service after the publication of changes constitutes acceptance of the new Terms.
2. Service Description
Tennis-IA is a platform that offers:
- Biomechanical analysis — technical analysis of tennis strokes using artificial intelligence based on videos uploaded by the user.
- AI Coach — virtual assistant for personalized technical advice.
- Community — social features for sharing analyses, posts, comments, and interacting with other users.
- Messaging — direct messages between registered users.
- Rankings and challenges — gamification systems to encourage improvement.
3. Registration and Account
To use the Service, you must create an account using an email address or by signing in with Google, Facebook, or Apple. The user is responsible for:
- Providing truthful and up-to-date information.
- Maintaining the confidentiality of their login credentials.
- All activities that occur through their account.
TennisIA reserves the right to suspend or delete accounts that violate these Terms, without prior notice and without obligation of refund.
Users must be at least 16 years old to create an account. If you are between 16 and 18 years old, you declare that you have the consent of a parent or legal guardian.
4. User Content
Users can upload, publish, and share content through the Service, including videos, images, texts, comments, and messages (hereinafter "User Content"). The user remains the owner of the rights to their Content, but grants TennisIA the following:
License to Use: By uploading Content to the Service, the user grants TennisIA a non-exclusive, royalty-free, worldwide, transferable, and sub-licensable license to use, reproduce, modify, process, and display such Content solely for the purpose of providing, improving, and promoting the Service. This license terminates upon deletion of the Content or account, except for content already shared with other users or integrated into aggregated and anonymous content.
The user declares and warrants that:
- They own the rights or have obtained all necessary authorizations to upload and share the Content.
- The Content does not violate the rights of third parties, including intellectual property rights, image rights, and privacy rights.
- The uploaded videos depict the user themselves or have been shared with the explicit consent of the people filmed.
- The Content does not include illegal, defamatory, obscene, threatening, discriminatory, or otherwise violative material of these Terms.
5. User Conduct and Community Rules
The user undertakes not to use the Service for:
- Uploading content that is not related to tennis or sports activities.
- Publishing offensive, violent, sexually explicit, discriminatory, or illegal material.
- Harassing, intimidating, threatening, or stalking other users.
- Spreading spam, unauthorized advertising, or promotional content.
- Impersonating other people or creating fake accounts.
- Uploading videos depicting minors without the consent of parents or legal guardians.
- Attempting to access unauthorized accounts, data, or areas of the Service.
- Interfering with the operation of the Service or servers through attacks, scraping, reverse engineering, or other technical means.
- Using the Service for unauthorized commercial purposes.
TennisIA reserves the right to remove any content and to suspend or delete accounts that violate these rules, at its sole discretion and without prior notice. Moderation decisions are final.
6. Responsibility for Content
TennisIA is not responsible for content published by users. Each user is solely responsible for the content they upload, publish, or share through the Service.
TennisIA is not obligated to pre-monitor user content, but reserves the right to do so. In case of reporting or detection of illegal content or content violating these Terms, TennisIA will promptly remove it in accordance with applicable law.
The user agrees to indemnify and hold TennisIA harmless, along with its collaborators and suppliers, from any claims, damages, losses, costs, or expenses (including legal fees) arising from User Content or from the user's violation of these Terms.
7. Content Reporting and Removal
Users can report content deemed inappropriate or in violation of these Terms through the dedicated reporting function available in the app. TennisIA will review reports and take appropriate action within a reasonable timeframe.

8. Biomechanical Analysis and AI Coach — Limitations
The results of the biomechanical analysis and the advice from the AI Coach are generated by artificial intelligence systems and are exclusively for informational and educational purposes.
The user acknowledges and agrees that:
- AI results do not replace the advice of a qualified tennis instructor, sports physician, or physical therapist.
- The analysis is based on probabilistic models and may contain inaccuracies or errors. Scores and metrics are indicative and do not represent a certified evaluation.
- TennisIA is not responsible for injuries, physical damage, or performance deterioration resulting from applying suggestions provided by the AI.
- The user is solely responsible for decisions made based on the analyses and advice received.
- The quality of the analysis depends on the quality of the uploaded video (framing, lighting, resolution). Inadequate videos may produce unreliable results.
9. Subscriptions and Payments
The Service offers free and paid features. Subscriptions are managed through Apple App Store and Google Play Store and are subject to their respective terms and conditions.
- Automatic renewal: subscriptions automatically renew upon expiration, unless cancelled by the user at least 24 hours before renewal.
- Subscription management: cancellation and management of subscriptions occur exclusively through the App Store or Google Play Store settings.
- Refunds: refunds are subject to Apple and Google policies. TennisIA does not directly handle refunds for purchases made through the stores.
- Analysis tokens: purchased or received tokens are non-refundable, non-transferable, and have no monetary value outside of the Service.
- Price changes: TennisIA reserves the right to change subscription prices with reasonable notice. Changes do not apply to the current subscription period.
10. Intellectual Property
The Service, including its design, source code, logos, trademarks, texts, graphics, artificial intelligence algorithms, and all its constituent elements, is the exclusive property of TennisIA and is protected by Italian, European, and international intellectual property laws.
The user is granted a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms. It is forbidden to copy, modify, distribute, sell, license, or create derivative works from the Service.
11. Service Availability
TennisIA strives to ensure the continuity of the Service, but does not guarantee that the Service will always be available, uninterrupted, or error-free. The Service may be temporarily suspended for maintenance, updates, or force majeure.
TennisIA reserves the right to modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without prior notice. In the event of definitive termination, users will be informed with reasonable advance notice.
12. Limitation of Liability
To the extent permitted by applicable law:
- The Service is provided "as is" and "as available", without warranties of any kind, express or implied.
- TennisIA is not liable for direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service.
- TennisIA is not responsible for interactions between users, including messages, shared content, and behavior within the community.
- TennisIA is not responsible for the loss of user data, content, or progress.
- TennisIA's total liability to the user shall in no event exceed the amount actually paid by the user for the Service in the 12 months preceding the event giving rise to the claim.
13. Applicable Law and Jurisdiction
These Terms are governed by Italian law. For any dispute arising from these Terms or the use of the Service, the parties will attempt an amicable resolution. In case of failure to agree, the Court of Milan shall have exclusive jurisdiction.
For consumers residing in the European Union, the rights provided by the mandatory legislation of their country of residence and the right to resort to the European online dispute resolution (ODR) platform remain unaffected: ec.europa.eu/consumers/odr.
